On the afternoon of December 7, a lecture on the Personal Information Protection Law was held in the second meeting room of Building A, Business School, University of Shanghai for Science and Technology. The guest speaker Mr. Xumiao Wang, a lawyer and the executive director at Shanghai Hanhong Law Firm, gave a speech on Legal Protection of Personal Information in the Era of Big Data: The Understanding and The Practice of the Personal Information Protection Law. The lecture was hosted by Dr. Xiaodong Zhu, Associate Professor at the Department of Information Management and Information Systems.
In November 2021, the Personal Information Protection Law of the People's Republic of China was promulgated and implemented. How it can be used to protect personal rights and interests has become an urgent concern to the general public. The guest speaker gave a wonderful lecture with abundant cases to enhance the audience’s legal awareness. At the beginning, Mr. Wang introduced the topic of the lecture with a real-life case: the push notifications of Toutiao. Through this lecture, students learn that what rights do I have, what are the obligations of institutions, enterprises, and companies, and if the company infringes my rights, what can I do. Then, Mr. Wang shared an in-depth analysis of the Personal Information Protection Law and clarified the seven rights of individuals: the right to know and to decide relating to their personal information, the right to consult and copy their personal information, the right to transfer and to correct or supplement their personal information, the right to delete and to request explanations of the personal information handling rules. Mr. Wang further described the five principles of handling personal information with more cases. At the end, he clarified that when an individual’s personality right is violated, the victim has the right to request the perpetrator to bear civil liability according to the Civil Code of the People's Republic of China and other laws.
After the speech, students actively participated in the Q&A session. For example, some students asked why did they receive unwanted calls about whether they were interested in buying an apartment even though they believed that there was no information leakage. Other students wondered that when conducting scientific research with the data collected from the Internet, how to make sure that there were no violations of the law. Mr. Wang gave detailed answers to each question.
At the end of the lecture Dr. Xiaodong Zhu, Associated Professor at the Business School, made a summary: “On the one hand, this lecture has enhanced the audiences’ legal awareness on personal information protection, which is of great practical significance. On the other hand, Mr. Wang shared his rich experience in handling cases and enriched the knowledge of the audience. Under the framework of national security, the promulgation and the implementation of the ‘Personal Information Protection Law’ further improves the law systems in the field of information security and consolidates the legal foundation of the new rules of data management in the era of big data.”
